Tougher rules on oil explorers signalled

The Government is moving to require deep-sea oil and gas explorers to have more safety plans in place.

Energy and Resources Minister Phil Heatley told TV3's The Nation programme that he would announce in the next few weeks a change to the Crown Minerals Act to make oil and gas operators more accountable for design, installation and the monitoring of their wells.

"They will need to put up a safety case scenario of exactly what they do in every single circumstance," he said.

He said the Marsden Point oil refinery had managed the movements of oil tankers successfully for 50 years by having good safety plans.

"We're saying when it comes to deep-sea oil and gas exploration they need the same plans in place. They need to operate just like Marsden Point does, very carefully, there is a plan for every scenario."

The Government has been keen to encourage more exploration of oil and gas deposits in New Zealand but has run up against an environmental lobby.

New Zealand has 18 basins with oil and gas deposits, and only one - the Taranaki basin - had been developed, Mr Heatley said.

India?s forex reserves rise by $589 mn (Lead)

Mumbai, July 29 (IANS) India?s foreign exchange (forex) reserves grew by $589 million to $287.34 billion for the week ended July 20, central bank data showed.

Foreign currency assets, the biggest component of the forex reserves kitty, increased by $565.5 million to $255.10 billion for the week under review, according to weekly statistical supplement released by the Reserve Bank of India (RBI).

The RBI did not provide any reasons for the growth. It said the assets in US dollar terms included the effect of appreciation or depreciation of non-US currencies such as the pound sterling, euro and yen held in reserve.

The country?s forex reserves had declined by $872.7 million in the previous week under review.

The value of special drawing rights (SDRs) grew by $15.8 million to $4.34 billion during the week ended July 20, while India?s reserves with the International Monetary Fund (IMF) rose by $7.7 million to $2.13 billion.

However, the value of gold reserves remained unchanged at $25.76 billion.

DOE's public affairs director leaving to teach in South America ...

Lenny Speiller, the education department?s head of public affairs whose stint was checkered by a lobbying incident that got him into trouble with city investigators, is making an unusual career move. He?s moving to Honduras to become a teacher.

Speiller?s exit is part of a restructuring within the Department of Education?s communication and legislative offices meant to improve how the DOE communicates with members of the public,?Chief Operating Officer Veronica Conforme told staff in an email this week.

Speiller?s role in charge of public affairs was to work with elected officials and community-based organizations on DOE initiatives and to curry support for the department?s legislative goals. Under a four-office merger, public affairs will be folded?into the External Affairs office. The other public-facing shops getting absorbed are: Communications, Digital Communications, and the Chancellor?s Strategic Communications Group (a spokeswoman told me the last one helps Dennis Walcott read and respond to emails from the public).

Jessica?Scaperotti, a former Cuomo aide who joined the department in April, will over see the new?streamlined?office. Elizabeth Rose, a public affairs official, will temporarily fill in for Speiller while a permanent replacement is found.

In announcing Speiller?s departure to staff, Conforme didn?t?offer much of a reflection on his two-and-a-half year tenure, which was filled with a busy legislative agenda. During his time, Speiller worked on the successful push to raise the state?s cap on ?charter schools and on the less-successful effort to reform teacher tenure laws.

But it was his work on the issue of seniority-based layoff laws that got him into trouble.

In October, Richard Condon, the?Special Commissioner of Investigation, found that Speiller?broke the law when he urged school employees to engage in political lobbying on the issue.

Here?s what we wrote?about the investigation in October:

During ?Lobby Week? in March,?Lenny Speiller, executive director of the DOE?s Office of Public Affairs, inserted language into an email to parent coordinators asking them to share a petition calling on lawmakers to do away with seniority layoff rules for teachers, investigators concluded. Mayor Bloomberg was pushing the policy change heavily at the time. But the state constitution prohibits public employees from engaging in private political lobbying.

Speiller was reprimanded by Chancellor Dennis Walcott, who ordered him to take ethics training classes. His personnel file also received a letter noting the incident.

The report found that Speiller worked closely on the issue with his predecessor,?Micah Lasher, who was?Bloomberg?s top Albany lobbyist?at the time. Speiller consulted in an email with Lasher on the political language used in the petition. Since Lasher did not respond to the email, he was not included in Condon?s investigation.

City Councilman Robert Jackson, who regularly butts heads with the DOE as chair of the education committee, called Speiller, ?a very cordial, diplomatic and level-headed person? to work with.

Jackson also said that the lobbying impropriety shouldn?t be held against him.

?I don?t think he did it on his own,? Jackson said. ?If he was told that that?s what he had to do, he either had to do it or he wouldn?t have his job.?

Lasher left the Bloomberg administration in April to take a job running the New York office of Michelle Rhee?s political action committee StudentsFirstNY.

Shortly after, Speiller spoke to Walcott about leaving, Scapperotti said in an email.

?Two months ago, Lenny spoke to the Chancellor about an opportunity for he and his wife to teach at a developing school in Honduras,? Scapperotti wrote in an email.

Speiller, whose last day of work is today, declined to comment through Scaperotti.

Speiller is the second top communications official to leave the DOE this year and there has been high turnover within the communications department in recent months. Communications director Natalie Ravitz left in January, which was followed by the departure of three other press officers.

Scapperotti said the reshufflng will improve how the DOE communicates with members of the public.

?This was done so we can better keep parents, teachers and the general public informed about DOE programs and initiatives,? she said.

Analysis: Rivals on left, right battle in Supreme Court

WASHINGTON (Reuters) - They are heavyweights in the ring that is the U.S. Supreme Court.

These button-down, Ivy League-credentialed versions of Muhammad Ali and Joe Frazier represent Washington versus the states and the competing left-right ideologies behind that conflict. And the punches they throw - and take - while at the courtroom lectern have captured as much attention as their stances on the law.

U.S. Solicitor General Donald Verrilli and Washington lawyer Paul Clement squared off over healthcare and immigration policy, the two biggest cases in the court term that ended in June. They are likely to do battle again over months, and perhaps years, to come.

Their rivalry arises largely from a distinct moment in U.S. legal history: Republican-controlled states have aggressively challenged the Democratic administration of President Barack Obama. Verrilli, appointed by the president, is the government's top courtroom lawyer. Clement, who was a solicitor general during the Republican administration of President George W. Bush and is now with Bancroft PLLC, has become the go-to lawyer for conservative states and other challengers of the administration.

"You have to go back a long way to find two people who are consistently representing such opposing views," said Andrew Pincus, a Washington lawyer who appears regularly before the court.

Not only are states increasingly locked in litigation with the federal government, Pincus said, but they are also going outside the offices of the states' attorneys general for Supreme Court specialists.

STUDY IN CONTRASTS

A 46-year-old Wisconsin native, Clement approaches the lectern below the justices' bench with no notes and a steady stock of rejoinders. He exudes confidence and seems to relish sparring with the nine justices, left and right.

Verrilli, 55 and a New York native, is low-key and soft-spoken. When he began as solicitor general last year, the justices sometimes had trouble hearing him. His presentations have been halting at times, and he stumbled when he began his defense of the healthcare law's insurance mandate during the March session.

Verrilli coughed as he started to speak, then choked on a gulp of water. Overall, he had a rocky time before a bench dominated by conservative justices, who pummeled him with skeptical queries. At one point when Chief Justice John Roberts told Verrilli he had an extra 15 minutes, Verrilli said with a sigh, "Lucky me. Lucky me."

News commentators lambasted Verrilli's performances in the healthcare and immigration disputes and contrasted them with Clement's fluid style. Some deemed his arguments nearly fatal for the Obama administration.

Setting the tone for much of the healthcare postmortem, CNN commentator Jeffrey Toobin proclaimed Verrilli's arguments in March "awful" and "a train wreck."

In the end, Verrilli, on behalf of the administration, prevailed as the court upheld the requirement that most Americans buy health insurance and ruled, in the immigration case from Arizona, that federal law overrides most state policy.

Only this week did Verrilli publicly comment on his performance and the media drubbing. On a panel at the Heritage Foundation in Washington, D.C., on Wednesday, he first took a lighthearted approach. As he was about to begin his panel presentation, he said, "I'm just going to take a sip of water here." The audience laughed knowingly, recalling the dry throat that got him off to a bad start during March arguments.

In response to a question later about the criticism, he said, "I'm a government official. I've got a weighty responsibility. I ought to be subject to criticism like any other official with a weighty responsibility. And I guess I was. I'm OK with that."

LEGAL SCORECARDS

Clement has 62 Supreme Court arguments under his belt, Verrilli, 21. This term, Clement argued seven cases, winning four and losing three. Verrilli split his six: three wins, three losses. Such scorecards are imperfect indicators of a lawyer's skill: For the justices, much depends on the validity of each side's core legal position and how they fit with past relevant cases.

The two advocates confront each other indirectly - through the justices, in fact. Each individually fields questions for his respective time, usually 30 minutes a side.

Outside the courtroom, things can be even tamer. Verrilli and Clement are part of a league of appellate lawyers that rarely engages in personal criticism. They are among the best-mannered of their ilk, down to their starched shirts and cuff links. At a Georgetown University law school event in March, Verrilli said he held Clement in high regard. Clement, vacationing this week, said in a brief email exchange, "I think the world of Don." Both men declined further comment for this story.

Verrilli, tall with a salt-and-pepper mustache, and Clement, medium height with thinning brown hair, climbed the elite ranks of the law in similar fashion. But once they set on a professional path, they diverged in political and ideological affiliations.

Verrilli, who attended Yale University and then Columbia University law school, was a law clerk to jurists known for their liberalism: Supreme Court Justice William Brennan and, earlier, U.S. Appeals Court Judge Skelly Wright of the District of Columbia Circuit.

Clement attended Georgetown University and Harvard Law School. His mentors were leading lights of conservatism: Supreme Court Justice Antonin Scalia and, earlier, U.S. Appeals Court Judge Laurence Silberman of the District of Columbia Circuit.

Clement became principal deputy to U.S. Solicitor General Theodore Olson in 2001, then gained the top SG job in 2005, a year short of age 40.

Verrilli, who spent two decades in the Washington office of Jenner and Block, was already in his 50s when he joined the Obama administration in 2009. He became solicitor general in June 2011, succeeding Elena Kagan, appointed by Obama to the Supreme Court in 2010.

RHETORICAL BLOWS

The rivalry between Verrilli and Clement comes down mainly to a debate over the respective powers of the federal government and the states.

In the healthcare dispute, Clement represented 26 states that said the Affordable Care Act tread on their sovereignty. When Clement argued on behalf of Arizona in the immigration case, he said states should be able to set their own policies to keep people from crossing the border illegally and then burdening state resources.

Clement took the side of Texas in a voting-districts dispute, and Verrilli's office sided partly with the challengers. In September, Clement will face off against the Obama administration in a lower court over South Carolina's strict voter photo-identification law.

The closest comparison to Clement that court watchers draw is with Jeffrey Sutton, now a U.S. appeals court judge in Ohio, who in a few late-1990s and early-2000s federalism cases at the Supreme Court represented state officials, including those in Alabama and Florida.

Clement's relationship with states and conservative causes is more prevalent and prominent.

Republican Texas Attorney General Greg Abbott, who hired Clement to defend a state voting-district map at the Supreme Court earlier this year, said Clement was the first choice when states seek outside counsel.

"If you don't go with him," Abbott said, "you have to question why you are not."

COMING ATTRACTIONS

The next high-profile matchup between Verrilli and Clement is likely to be over the Defense of Marriage Act, which denies Social Security payments and other federal benefits to same-sex spouses. On June 29, Clement filed a petition at the Supreme Court on behalf of the U.S. House of Representatives Bipartisan Legal Advisory Group, defending the law's constitutionality. The GOP House leadership hired Clement after the Obama administration said last year it would no longer support the statute defining marriage as only between a man and a woman.

It is difficult to predict how the two will fare in that case, should the court decide to hear it in the term that begins on October 1. Throughout the last term, their respective fates defied much of the conventional wisdom.

When the justices ended up siding with Verrilli on the Obama healthcare plan, cards and letters of congratulations poured into his office. Along with them came a reminder of one well-known argument from challengers - that if the government could force people to buy health insurance, it could force people to eat healthy vegetables. A Justice Department colleague sent Verrilli a decorative arrangement of fruit. It was mainly broccoli, with a few pieces of cantaloupe mixed in.

How to play a specific song with Siri

  1. Press and hold down the Home button to activate Siri.

UK scientists will measure the effect on the marine environment and wildlife of devices that harness tide and wave energy using sonar technology that has, for the first time, been successfully deployed on the seabed.

Renewable energy from tidal currents can be generated using turbines in the tidal flow, and wave energy can be captured in a number of different ways. FLOWBEC (Flow and Benthic Ecology 4D) is a three-year, 1.2 million project that brings together a consortium of researchers to investigate the effects of such devices by monitoring environment and wildlife behaviour at UK test sites, the first of which is the tidal energy test area of the European Marine Energy Centre (EMEC) in Orkney.

FLOWBEC is a National Oceanography Centre (NOC)-led project, which is funded by the Natural Environment Research Council and Defra (the Department for Environment, Food and Rural Affairs). It brings together scientists from the Universities of Aberdeen, Bath, Edinburgh, Exeter, Plymouth, Queens University Belfast, Plymouth Marine Laboratory, Marine Scotland Science, the British Oceanographic Data Centre, EMEC, and one of the world's leading tidal turbine developers, OpenHydro Ltd.

The researchers from the Universities of Bath and Aberdeen, together with the expert acoustic and technical teams at Marine Scotland Science, have combined two state-of-the-art sonar systems on a seabed frame placed within 25-metres of an OpenHydro structure. This monitors fish and diving seabirds that pass through or feed within the location; in particular, the study is assessing how fish and seabirds interact with the installation.

For the first time these sonars - which are normally mounted on a ship as separate units looking down at the seabed - have been adapted to operate autonomously in combination for several weeks, while facing upwards. Collecting the data in this way allows imaging of a full `acoustic curtain' along the tidal flow and around the turbine in a highly challenging environment.

A marine radar, deployed by the NOC, has also monitored activity on and above the sea surface, mapping the extreme currents and waves at the site and tracking the behaviour of birds and marine mammals in the immediate area. Along with all the high tech instrumentation, a skilled birder, University of Aberdeen PhD, James Waggitt, made observations on high ground nearby which identified the times and types of seabirds diving for food within the site.

The researchers are working together to identify the wildlife and their behaviour detected by the monitoring systems. They will investigate how the various species choose to use areas of the water column with different physical characteristics, and how the surrounding environment is affected by the presence of this renewable energy structure.

By understanding behavioural preferences, they hope to be able to understand how changes to water flow and turbulence introduced might affect the various types of marine wildlife and identify their interaction with tidal technology.

The FLOWBEC team deployed the sea bed frame containing the sonar systems at the EMEC tidal energy test site for two weeks at the end of June, and have now begun processing the data. The early results were presented at the European Conference in Underwater Acoustics in Edinburgh last week (from July 2-6). The team will also be conducting studies at the WaveHub site off the Cornish coast, and in Strangford Lough in Northern Ireland.

Dr Philippe Blondel, Senior Lecturer in Physics and Deputy Director of the Centre for Space, Atmosphere and Ocean Science at the University of Bath, said: "Using waves and tides as a renewable energy source is more predictable than solar or wind energy, and of course there isn't the same visual impact. Tidal energy devices alter the local water flow and this project aims to measure and assess whether this has an effect on the wildlife around it.

"We'll be sharing the knowledge gained with other users and providing data as an open resource for environmental scientists at the end of the project. Our presentation of the first results at the European Conference in Underwater Acoustics, a few days after recovery, has been extremely well received by operators and researchers working with marine renewable energies."

Dr Beth Scott, Senior Lecturer in Marine Ecology at the University of Aberdeen, said: "It is an amazing feat of collaboration, involving such a wide range of expertise, that has allowed us to produce and successfully deploy the combined type of instruments that will finally start to provide the ecological information so badly needed by the marine renewables industry.

"After detailed analysis these data will determine how mobile animals, such as seabirds and their fish prey, behave around marine renewable devices over an entire fortnightly tidal cycle as the instruments successfully 'pinged' away and collected data for every second of that two-week period. This research will help to determine the actual risk of collision between marine animals and turbines and will allow governmental marine spatial planners a step change in the level of certainty about where to allow renewable developments. "

Dr Jennifer Norris, Research Director at EMEC, said: "EMEC has been working closely for many years with the regulators, their advisors, on-site developers and various experts to develop methodologies for assessing environmental interactions with devices. The system successfully trialed in FLOWBEC will gather key data sets required to fill some of the knowledge gaps needed to inform this emerging industry. EMEC is also working on a parallel project called ReDAPT which is currently commissioning a cabled monitoring pod, including an active sonar system, and the learning generated from these complementary projects will be of direct benefit to the industry."

Dr Paul Bell, a marine physicist at the NOC who is leading the project, said: "This is a truly multidisciplinary study bringing together researchers from all over the UK to shed light on how extracting wave and tidal energy from our oceans might affect the environment. If there are effects they could be beneficial to wildlife - but if any are negative, our research may suggest ways of avoiding them in future designs."

UK scientists will measure the effect on the marine environment and wildlife of devices that harness tide and wave energy using sonar technology that has, for the first time, been successfully deployed on the seabed.

Renewable energy from tidal currents can be generated using turbines in the tidal flow, and wave energy can be captured in a number of different ways. FLOWBEC (Flow and Benthic Ecology 4D) is a three-year, 1.2 million project that brings together a consortium of researchers to investigate the effects of such devices by monitoring environment and wildlife behaviour at UK test sites, the first of which is the tidal energy test area of the European Marine Energy Centre (EMEC) in Orkney.

FLOWBEC is a National Oceanography Centre (NOC)-led project, which is funded by the Natural Environment Research Council and Defra (the Department for Environment, Food and Rural Affairs). It brings together scientists from the Universities of Aberdeen, Bath, Edinburgh, Exeter, Plymouth, Queens University Belfast, Plymouth Marine Laboratory, Marine Scotland Science, the British Oceanographic Data Centre, EMEC, and one of the world's leading tidal turbine developers, OpenHydro Ltd.

The researchers from the Universities of Bath and Aberdeen, together with the expert acoustic and technical teams at Marine Scotland Science, have combined two state-of-the-art sonar systems on a seabed frame placed within 25-metres of an OpenHydro structure. This monitors fish and diving seabirds that pass through or feed within the location; in particular, the study is assessing how fish and seabirds interact with the installation.

For the first time these sonars - which are normally mounted on a ship as separate units looking down at the seabed - have been adapted to operate autonomously in combination for several weeks, while facing upwards.
